Rental - Occupancy Compliance

The Occupancy Compliance resources below are available to guide Sponsor and Owner organizations to know what information and documentation must be collected, and maintained, in the tenant files. Becoming familiar with these requirements will ensure your project is on the path to successful compliance for the AHP project’s 15-year retention period.

This information should be shared with anyone that is involved with the tenant application review and intake process to ensure appropriate tenants reside in the property and that the approved AHP commitments are being met.

Underserved Communities - Requirements

  • Homeless Households

    Documentation must be available demonstrating that the percentage of units reserved for homeless households committed to in the approved AHP application (20%, 50% or 75%) are occupied by households that qualify as homeless.

    Our FHLB Homeless definition listed in the AHP Implementation Plan must be met. We do not utilize chronic homelessness or LTH definitions.

    Homeless Certification 

    For Project Completion Reporting purposes, a project with existing homeless households at the time of AHP application can use those households who would have met the definition of homelessness when they moved into the project on or after one year prior to the AHP application submission date.

    Example: An occupied project submits their AHP application on May 25th, 2025. Only those tenants that met our FHLB Homeless definition that moved into the project on or after May 25, 2024, would qualify as meeting the FHLB Homeless commitment.

    The FHLB Homeless Certification should be fully completed prior to, or at move-in, by the tenant and Sponsor or Service Provider. The FHLB Homeless Certification must be maintained in the tenant’s file.

  • Special Needs Populations

    Documentation must be available demonstrating that the percentage of units reserved for special needs households committed to in the approved AHP application (20%, 50%, and 75%) are occupied by households that qualify as special needs.

    Allowed categories: elderly, disabled, formerly incarcerated persons, unaccompanied youth, persons recovering from substance or physical abuse (may include dating violence, sexual assault or stalking and domestic violence), or persons with HIV/AIDs.

    • Elderly: 62 years of age or more.

    The AHP Rental Special Needs Tracking Sheet must be completed by the Sponsor for our Project Completion Reporting review.

  • Veterans

    Documentation must be available demonstrating that the percentage of units reserved for veteran households committed to in the approved AHP application (20% or 50%) are occupied by households that qualify as veterans.

    A veteran is defined as any member of the AHP-assisted household who served in the active U.S. military, naval, or air service, and was discharged or released under conditions other than dishonorable. Does not include surviving household members.

    FHLB requires a copy of the veteran’s DD214 be obtained prior to, or at move-in, demonstrating the veterans’ discharge status. The DD214 must be maintained in the tenant’s file.

  • Agricultural Workers

    Documentation must be available demonstrating that the percentage of units reserved for agricultural worker households committed to in the approved AHP application (20% or 50%) are occupied by households that qualify as agricultural workers.

    An Agricultural Worker is defined as any person or household that receives more than 50% of their income from the primary production of agricultural or aqua cultural commodities. Canning, animal and animal-by-product processing are excluded.

    The AHP Agricultural Worker Tracking Sheet must be completed by the Sponsor for our Project Completion Reporting review. And third-party income documentation evidencing 50% of the household’s income is from an agricultural or aqua cultural commodity must be maintained in the tenant’s file.
